Eight-year-old Charlie lives with Vivian, his mother, at one end of the school district, served by a very poor elementary school, to which Charlie can walk. His father, George, lives at the other end of the district near a school that the court determines is better educationally. George seeks a change of custody, so that Charlie can live with him and attend the better school. The parents live only 10 miles apart, but the commute by city bus is 45 minutes, George could not do the commute alone, and neither parent’s work schedules would allow them to accompany George back and forth to school from Vivian’s house. A highly publicized case of battering involved Barbara Sheehan, who shot and killed her husband after 17 years of physical and emotional abuse. He was a retired New York police officer and, according to testimony at trial by Sheehan and her children, his abuse included throwing boiling pasta sauce in her face and punching her in the face on the evening before the killing. Sheehan told the jury that on the day of the shooting, she took a loaded revolver that belonged to her husband and attempted to sneak out of the house following an argument in whichhe threatened to kill her if she continued to refuse to accompany him on a Florida vacation. As she passed by the bathroom where her husband was shaving, he tried to stop her by taking a semiautomatic pistol and aiming it at her head. She then shot him, and he reportedly fell to the floor and screamed that he was going to kill her. As he reached for his pistol, she then shot him ten more times. Prosecutors attempted to characterize Sheehan as a pathological liar who murdered her husband because she despised him after years of a dysfunctional marriage and thencloaked herself in a false story of chronic abuse. They also claimed that her fatal shot occurred after her husband presented no real threat, and that Sheehan had not sought help from the police or from family members living close by.Jurors had the option of convicting her for anything ranging from second degree murder (with a possible sentence of 25 years) to unlawful possession of a firearm (with a possible sentence of 3 ½ to 5 years), or acquitting her on all charges. If you were on the jury, how would you vote? How would you respond to other jurors with a different view?11 “A person committing second-degree murder, while not premeditated, has full understanding of their actions and kills someone anyway. Manslaughter involves a circumstance that may cause a reasonable person to become emotionally disturbed or considered as a murder fueled by passion or impulse.” You should consider whether convicting Sheehan of voluntary manslaughter is appropriate as well. 2
