LEGAL ENTANGLEMENT PROJECT – PART 1: MORAL AND LEGAL ISSUES INSTRUCTIONS
Analysis
In the Legal Entanglement Project, you will analyze a particular school’s strategies, policies, programs, and practices regarding their moral, legal, and ethical implications. The analysis will assist you in selecting a topic that—left unaddressed—could potentially become a liability or a legal entanglement. Your exploration of the knowledge base on the selected topic will result in a legal entanglement Project that will be communicated to appropriate stakeholders. Use the assigned template for Part 1 of the Legal Entanglement Project.
You will complete this benchmark assignment in 7 separate sections:
Part 1—Analysis: Moral and Legal Issues
Part 2—Analysis: Collaboration
Part 3—Knowledge Base: Case Review
Part 4—Knowledge Base: Literature Review
Part 5—Legal Entanglement Project: Paper
Part 6—Legal Entanglement Project: PPT
Part 7—Final Upload to BB and/or LT
Analysis: The purpose of the analysis is for you to select a meaningful and relevant topic in a particular school. If you are currently a school employee, you will use your school policy for the analysis. If you are not currently working in a school, you will want to reach out to a school where you might have connections (i.e., as a parent, where you have friends who work in a school, etc.). If you do not have connections, you will need to analyze a policy that is available online. The topic is to be a legal, moral, or ethical issue that—left unaddressed—could escalate into a legal entanglement (i.e., litigation).
As each part of this project builds from one section to the next, it is important to make corrections as you continue working on the subsequent part.
In the template, there are two sections, Part A and Part B:
Part A: Moral and Legal Issues in School Policy: The first step in selecting a topic is for candidates to analyze school policy regarding moral and legal implications. Evaluate the policies in regard to the potential they have to be problematic morally and/or legally. Using the assigned template, complete the first part of the chart (part A), including what the policy currently states regarding an area of potential litigation. If an issue is identified in the school but there is not current policy in place, candidates may suggest adding the policy to the current handbook. In the “Sound School Strategies” section of Part A, be sure to include a narrative analyzing the policy in regard to moral and legal implications.
Part B: Values in School Policies, Programs, and Practices: The second step in selecting a topic is for candidates to critique the school policy listed in Part A. Candidates will critique the policies, programs, and practices in regard to the values or lack thereof inherent in them—specifically the values of social justice, equity, confidentiality, acceptance, and respect between and among students and faculty within the school. For Part B, discuss how the policy in Part A would/could be amended to avoid potential litigation. Be sure to consider social justice, equity, confidentiality, acceptance, and/or respect between and among students and faculty. For Part B: Upholding Values, discuss how you can uphold values in the face of adversity. Consider how this amended policy will serve the greater good for the school community.
When completed, the template should be 1–2 pages and include a title page and reference page.
